Liability Waiver + Assumption of Risks

This Agreement is between Julieta Chiara LLC, a Florida limited liability company (“Company”), and the undersigned/accepting participant (“Participant,” “you”). By purchasing, enrolling in, accessing, or attending any offering from the Company, you confirm you have read, understood, and voluntarily agree to all terms below.

1) Activities Covered

This Agreement applies to all Company offerings, including:

  • Online/virtual classes, courses, live streams, tutorials, demonstrations, and downloadable materials

  • In-person lessons, workshops, intensives, private sessions, events, and photo/video demonstrations

  • Self-tying, partner-tying, floor work, partial or full weight-bearing positions, and any rope/kink-adjacent drills or exercises

  • Use of any equipment or spaces provided or suggested by the Company

2) Eligibility, Health, and Personal Responsibility

  • You are 18+ and participating of your own free will.

  • You accept full responsibility for your choices, limits, and conduct, including with any partners you invite to participate.

  • You will not participate under the influence of alcohol, recreational drugs, or impairing medication.

  • You agree to consult a qualified healthcare professional about your individual risks before participation.

  • You understand the Company cannot and does not evaluate your fitness to participate or the safety of your environment/equipment.

Common conditions that may increase risk include: circulatory disorders; cardiovascular or respiratory conditions; diabetes; nerve compression/neuropathy; spine or joint issues; hypermobility (e.g., EDS/HSD); clotting disorders; pregnancy/postpartum; recent injury or surgery; significant anxiety, PTSD, or panic disorders; and any condition affecting skin integrity or wound healing. If any apply, you will obtain medical clearance and modify/abstain as needed.

3) Inherent Risks of Rope/Shibari and Kink-Adjacent Practices

You acknowledge these activities carry unavoidable risks, including but not limited to:

  • Nerve issues: neuropraxia/nerve compression (e.g., radial, ulnar, median, peroneal), temporary or prolonged numbness/tingling, weakness, loss of motor function, wrist drop/foot drop

  • Circulatory issues: impaired blood flow, ischemia, vascular occlusion, blood pooling, fainting/syncope, dizziness

  • Musculoskeletal injuries: strains/sprains, joint subluxation/dislocation, muscle tears, back/neck injuries, repetitive-strain injuries, overuse injuries, cramps

  • Skin and soft tissue: rope burn, abrasions, bruising/hematoma, pressure sores, blistering, allergic reactions (e.g., to jute/hemp, latex, finishes/dyes)

  • Airway/breathing risks: positional asphyxia, restricted chest expansion in certain positions, vagal responses

  • Falls and load-bearing incidents: anchor failure, hardware failure, loss of balance, slipping/tripping, equipment malfunction, dropped loads

  • Rarer but serious risks: compartment syndrome, rhabdomyolysis, nerve palsy requiring medical care, loss of consciousness, concussion, and other emergencies

  • Psychological/emotional: activation of trauma responses, panic, dissociation, dysphoria, conflict with partners, delayed emotional reactions

  • Environmental: inadequate anchors, poor flooring, heat stress/dehydration, obstructed spaces, pets/people interrupting, travel hazards

You understand that instruction in “safety practices” reduces but does not remove risk.

4) Safety Commitments You Agree To

  • Keep safety shears/cutting tool within immediate reach at all times.

  • Stop immediately for numbness, tingling, coldness, color change, sharp pain, breathing difficulty, dizziness, or distress.

  • Avoid any neck constriction, breath restriction, or airway-compromising practices. The Company does not teach or endorse breath control/asphyxiation.

  • Use only appropriate, load-rated equipment and anchors installed/verified by qualified professionals.

  • Do not attempt partial/full suspension until you have appropriate training, gear, and in-person mentorship; always use a trusted spotter.

  • Check circulation and nerve lines frequently; reposition or untie promptly if issues arise.

  • Pre-plan aftercare and have an emergency plan, including how to safely exit ties fast and how to seek medical attention.

5) Consent, Boundaries, and Conduct

  • You are responsible for consent and communication with any partners. The Company teaches frameworks (e.g., pre-negotiation, traffic-light systems) but cannot supervise private conduct.

  • You may decline or modify any activity for any reason at any time.

  • The Company may refuse or discontinue your participation if safety, consent, or respectful conduct is in question—without refund where allowed by law and posted policies.

6) Online-Specific Limitations

  • Remote instruction limits what the Company can see, assess, or intervene in. Camera angles, bandwidth, and latency reduce situational awareness.

  • You are solely responsible for creating a safe environment: anchors, flooring, lighting, clearance, partner selection, and privacy.

  • You accept that demonstration of a concept online does not guarantee it is appropriate for your body, gear, or space.

7) Assumption of Risk

You understand and expressly assume all risks, known and unknown, ordinary and extraordinary, associated with participation in the Activities, whether arising from your actions, inaction, the actions of others (including partners), equipment or environmental factors, or instruction limitations (especially online).

8) Release, Waiver, and Hold Harmless

To the fullest extent permitted by law, you release, waive, discharge, and hold harmless the Company; its owner, members, employees, contractors, assistants, volunteers, venue partners, affiliates, and insurers from any and all claims, demands, causes of action, damages, costs, or expenses (including attorneys’ fees) arising out of or related to your participation in the Activities, including claims of ordinary negligence.

9) Indemnification

You agree to defend, indemnify, and hold harmless the Company and its representatives from any third-party claims or losses arising from your participation, conduct, or violation of this Agreement, including with respect to partners you invite to participate.

10) No Medical, Legal, or Mental-Health Advice

Content is educational only and not a substitute for professional medical, legal, or mental-health advice, diagnosis, or treatment. Seek appropriate professionals as needed.

11) Intellectual Property

All materials are owned or licensed by the Company. You receive a limited, personal, non-transferable license for your own learning. No recording, redistribution, resale, public performance, or derivative works without written permission.

 

12) Payments, Refunds, and Scheduling

Purchases are subject to posted terms on the sales/checkout page. Cancellations, refunds, and rescheduling follow those terms.

13) Compliance With Laws

You will only participate where such activities are lawful. You are responsible for complying with local laws, venue rules, and any travel or customs regulations related to gear.

14) Governing Law; Venue; Dispute Resolution

This Agreement is governed by the laws of the State of Florida, without regard to conflict of law rules. Exclusive venue for any dispute shall be in state or federal courts located in Miami-Dade County, Florida.

15) Severability; Entire Agreement; Modifications; Electronic Acceptance

If any provision is unenforceable, the remainder remains in effect. This is the entire agreement on the subject matter and may only be modified in writing by the Company. Your electronic checkbox while purchasing and continued participation constitutes acceptance.
